A design patent is a form of intellectual property right that protects the ornamental design of an article of manufacture. Examples include jewelry, furniture, beverage containers and computer icons. Unlike utility patents, design patents can only be granted for novel and non-obvious designs. In order to be valid, a design must be distinguishable from prior art designs.
